Widow drops lawsuit against Amherst homeowner

BUFFALO, N.Y. (AP) - The widow of an Albany schoolteacher who was fatally shot after wandering into a stranger's house near Buffalo has dropped a lawsuit against the homeowner.

David Park was killed in March when he entered the Amherst home at 1:30 a.m. Police said Park was drunk and had been attending a party next door.

A grand jury declined to file charges against homeowner David D'Amico after concluding he had reasons to fear for his safety.

Deanna Ripstein's lawyer issued a statement Monday saying she had withdrawn the wrongful death suit "after careful consideration." The suit had been filed earlier this month in state Supreme Court.
