Court announces new filing fees

Effective Sept. 1, the Uniform City Court Act was amended to impose an additional $95 fee for "filing the first paper in an action or proceeding arising out of a consumer credit transaction," according to a statement released by the New York State Unified Court System.

That raises the total filing fee to $140.

The legislation also amends the act to require payment of $95 upon the filing of a judgment in a CLPR 105(f) consumer credit transaction or proceeding commenced prior to Sept. 1 where no additional fee has been paid.

Also effective Sept. 1, CPLR 8018 is amended to allow county clerks to collect a $190 fee for the assignment of an index number "in an action to foreclose pursuant to article 13 of the real property actions and proceedings law." The additional fee will bring the total cost of obtaining an index number to $400.
