Erie County wants suit over 2 jails tossed out

BUFFALO (AP) - Erie County officials are asking a judge to throw out a Justice Department lawsuit claiming that two county jails routinely deprive inmates of constitutional rights by not protecting them from violence, sexual misconduct and suicide.

Erie County Attorney Cheryl Green Wednesday told U.S. District Judge Hon. William Skretny that it's hard even to respond to the September lawsuit because it lacks specifics. She said the Erie County Holding Center in Buffalo and Erie County Correctional Facility in Alden meet minimum standards for the treatment of inmates.

Government lawyers say the complaint may be brief, but contains enough to show deliberate indifference on the county's part.

Skretny did not immediately rule on the request.
