Appeals court reverses ruling on 2005 inauguration protest

WASHINGTON (AP) - The U.S. Court of Appeals has reserved a ruling that the arrests of several protesters on the eve of the second inauguration of President George W. Bush was unconstitutional.

In a ruling Friday, the court ordered that the case be returned to District Court, including possibly a trial.

The incident happened in January 2005, when a parade without a permit in the Adams Morgan neighborhood of Washington, D.C., became destructive. About 70 people were arrested; all were released, and none were charged.

Five of those arrested sued, claiming that their arrests violated the Fourth Amendment, because the police could not have had probable cause to arrest them.
