Court: Companies can get both rebates and refunds on power

ALBANY (AP) - New York's top court says companies participating in a program that provides low-cost power in return for promises to keep jobs in the state can get both rebates and refunds and are not limited to one or the other.

The Court of Appeals says that while the Legislature repeatedly extended the Power for Jobs program since its 1997 start, documents show that lawmakers intended to expand benefits to companies.

The New York Power Authority cited concerns about "double dipping," with companies getting rebates for energy costs when buying from local power providers or direct restitution when buying from NYPA.

Authority spokeswoman Christine Pritchard says further analysis is needed to determine the cost of the decision, which was released Wednesday.
