Trucker in crash accused of hiding health disorder

NEW YORK (AP) - A New York prosecutor says a truck driver hid his medical condition before an accident that killed two English tourists and resulted in murder charges.

Manhattan Assistant District Attorney Chris Ryan said Monday that Auvryn Scarlett was diagnosed with a seizure disorder in 1997 and became a truck driver the next year.

The indictment said Scarlett, of Irvington, N.J., admitted to police that he failed to take his medication.

The February 2008 accident claimed Jacklyn Timmons and Andrew Hardie. They lived in Yeovil, Somerset, about 130 miles from London.

Ryan said Scarlett went on disability leave from one trash-carting company after a May 2007 seizure. Then he allegedly got another job without divulging his condition.

Defense lawyer Michael Biniakewitz told jurors that Scarlett is not "evil," and never set out to kill anyone.
