Orchard Park developer spared jail in tax fraud

An Orchard Park real estate developer was sentenced Friday after pleading guilty in May to charges that he conspired to defraud the United States.

Victor Liberatore, 75, was sentenced to one year of home confinement and two years' probation by Hon. Richard Arcara, chief judge of U.S. District Court in Buffalo.

Liberatore was found guilty of altering documents and submitting $885,000 in false invoices to the IRS. He admitted to providing false information to investigators and causing others to do so during an audit between 2001 and 2004.

According to a statement released by the U.S. attorney's office for the Western District of New York, Arcara noted that Liberatore suffers from a serious medical condition and still faces civil matters related to the case, but spared the defendant jail.

As a partner in two enterprises, Terra Capital Associates and Terra Erie Associates, from 1999 through 2001, Liberatore admitted claiming tax deductions that applied for other properties. Furthermore, those deductions were repeated in some cases, on his personal tax return.

In addition to his home confinement, Arcara ordered Liberatore to pay a $10,000 fine, and $169,849 in restitution to the IRS.
