Judge allows interrogation video to be used as evidence

Mon, Jul 20th 2009 12:00 am
WASHINGTON (AP) - A Washington, D.C., Superior Court judge has decided to allow a recording of the defendant's police interrogation to be used as evidence in the murder trial of a woman accused of killing her four daughters.

Judge Frederick Weisberg on Wednesday denied a motion by Banita Jacks' attorneys to suppress statements she made to detectives after the decomposing bodies of her four daughters were found in her home in January 2008.

In the videotaped interview, Jacks said her daughters were possessed by demons.

Weisberg says that while Jacks appeared to be somewhat "emotionally fragile," her statements were voluntary. He says police acted appropriately the day of her arrest and did not violate her rights.

Defense attorneys had argued that police did not have enough evidence to arrest Jacks.
