Biker trying to get conviction in Trooper death overturned

ROCHESTER (AP) - A state appeals court is being asked to overturn the conviction of a Central New York motorcyclist convicted of leading a state trooper on a deadly chase in April 2006.

James Carncross of Jamesville is serving a seven-year sentence for trying to escape from Trooper Craig Todeschini and causing him to crash into a tree on a rural highway near Syracuse. The 23-year-old Carncross was convicted in December 2006 of aggravated criminally negligent homicide and reckless driving.

Prosecutors at a hearing of a midlevel appeals court in Rochester argued Wednesday that the conviction and sentence should stand.

Defense lawyers have raised more than a half dozen issues, including whether there was sufficient evidence to support the criminally-negligent-homicide conviction.
