NY court: No venue change for husband's murder retrial

OWEGO (AP) - An appeals court is refusing to move the trial of a millionaire upstate New York businessman facing a second trial in the slaying of his missing wife.

Calvin Harris is scheduled to go on trial Feb. 17 in Tioga County Court. The 47-year-old is charged with second-degree murder in the death of his 35-year-old estranged wife, Michele Harris, in September 2001.

Harris' lawyers wanted the trial moved to Albany, claiming that the county jury pool has been tainted by local and national media coverage. That request was rejected Jan. 5 by an appeals court.

Harris was found guilty in June 2007 of murdering his wife, whose body has never been found. His conviction was thrown out after a new witness came forward before he was sentenced.
