Upstate man awarded $2.6M for wrongful imprisonment

AUBURN (AP) - An Upstate New York man who was wrongly convicted and imprisoned for a 1991 murder will receive $2.6 million from the state.

The settlement was announced Tuesday as a trial to determine the amount due to Roy Brown was about to begin in the state Court of Claims.

Court of Claims Judge Hon. Nicholas Midey Jr. ruled last month that Brown was entitled to damages.

Brown sued the state in May 2007 seeking $5 million for his wrongful imprisonment.

He was sentenced to 25 years to life in prison after he was convicted in 1992 of second-degree murder for the death of Sabina Kulakowski. Brown served 15 years before the conviction was overturned in January 2007 because DNA evidence linked another man to the crime.
