Phillips appeal tossed out
The Appellate Division of state Supreme Court upheld Phillips' pleas in a decision issued Friday afternoon.
The panel of judges says the 46-year-old Phillips voluntarily admitted his intention to kill a trooper who was staking out his former girlfriend's property in rural Chautauqua County.
Phillips was convicted of shooting three troopers, one of them fatally, while on the run for five months in 2006. He was captured just across the state line in Pennsylvania, ending one of the largest manhunts in state history.
