State's highest court upholds removal of family court judge

ALBANY (AP) - New York's top court has upheld the removal of a Fulton County judge for misconduct, finding that he violated the rights of three people in Family Court cases by holding proceedings while they were jailed and therefore absent. He also refused to assign attorneys to two others who missed application deadlines.
The Court of Appeals, upholding findings by the state Commission on Judicial Conduct, concluded that Acting Supreme Court Justice Hon. David Jung imposed courtroom rules in custody and child support cases that denied litigants' rights to be heard or to have an attorney.
Vincent Capasso Jr., Jung's lawyer, says the judge served the people of Fulton County honorably for 20 years. They were disappointed by the decision but accept it, he said.
