NY Insurance Department seeks rule on commissions

The New York State Insurance Department has reiterated plans to introduce rules later this year requiring insurance brokers and agents to disclose to their clients the commissions they earn on policies they place.

No time frame has been announced. The department gave first notice of the rule change last June when it was published in the state Register, according to the industry publication, Insurance Journal.

Currently, New York insurance brokers and agents are not legally required to disclose commissions to their clients.

In a separate filing, the department said there is no legal limit to the length of time an insurer can withhold earned commissions from a broker. That ruling came after an unidentified broker questioned the practice of an insurer that had a policy of withholding commissions for 31 days, according to the journal.
