Schools don't have to cover disabled woman's education

NEW YORK (AP) - A federal appeals court has ruled that New York City's school system does not have to continue paying for the education of a disabled woman.

A three-judge panel in the 2nd Circuit Court of Appeals has reversed the decision of a lower court that would have allowed Alba Somoza to remain in a tailored education program.

The appeals court has found that Somoza's family filed a lawsuit against the Department of Education too late.

The 24-year-old Somoza has cerebral palsy, is quadriplegic and cannot speak. She had sought to become a museum lecturer through the tailored education program.

Her attorney, Salem Katsh, says he may appeal to the full 13-judge panel of the 2nd Circuit or even to the U.S. Supreme Court.
