the official Court Record for the Erie County Surrogate's Court. The digital image of all
Court records shall become the record of the court upon the completion of scanning
and digitization of said record.

STATE OF NEW YORK COURT OF APPEALS

The Court of Appeals has released its 2009 Calendar of Sessions. The schedule set
forth below includes the appeal sessions as well as the Court's conference days, which
are scheduled for June 22 and 23 and December 9 and 10. August 25 and 26 are
special election appeals session days.

SINDEPENDENT JUDICIAL ELECTION QUALIFICATION COMMISSION

NOTICE OF JUDICIAL VACANCIES
EIGHTH JUDICIAL DISTRICT

In accordance with Part 150 of the Rules of the Chief Administrator of the New York
State Courts, please be advised that the following judicial vacancies in the Eighth
Judicial District will be filled by election in November 2009:

1.) New York State Supreme Court (3 seats) 2.) Chautauqua County Surrogate's Court (1 seat)

Pursuant to Part 150 of the Rules of the Chief Administrator of the Courts, Independent Judicial Election Qualification Commissions ("IJEQC") have been established in each of the judicial districts of New York State. The IJEQCs are a statewide network of independent screening panels for judicial candidates. Each IJECQ is charged with the responsibility of reviewing the qualifications of candidates, within its respective judicial district, who submit a questionnaire and are seeking election to the following New York State Courts: Supreme, County, Surrogate's, Family, New York City Civil, District and City. Each commission has 15 members, comprised of both lawyers and non-lawyers, named by the Chief Judge, the Presiding Justices of the Appellate Divisions, the New York State Bar Association, and local bar associations.

All questionnaires for candidates seeking election to the above-referenced judicial offices should be submitted by June 1, 2009.  However, if a candidate submits a questionnaire within a sufficient period of time before the election, the Commission will make every effort to accommodate the application. STATE OF NEW YORK COURT OF APPEALS

PRIMARY ELECTION APPEALS

The Clerk's Office of the Court of Appeals and the Appellate Division Departments have released the following joint scheduling announcement:

The Departments have scheduled and reserved only the following dates to consider
appeals related to the September 15, 2009 primary elections:

First Department - Tuesday, August 18, 2009
(Wednesday, August 19, 2009, if necessary
Second Department - Tuesday, August 18, 2009
(Wednesday, August 19, 2009, if necessary)
Third Department - Thursday, August 20, 2009 Fourth Department - Wednesday, August 19, 2009

The Court of Appeals has scheduled and reserved Tuesday, August 25, and, if necessary, Wednesday, August 26, to consider appeals and motions for leave to appeal related to primary election matters.

Because there is limited time available between the primary election sessions of the Appellate Divisions and the Court of Appeals, parties who seek to have matters placed upon the Court of Appeals motions or appeals calendars must contact the Court of Appeals Clerk's Office for filing instructions promptly (usually at the time the decision of the Appellate Division is made known).

All parties, election boards and affected courts are expected to proceed expeditiously with all phases of election matters so that the requirements of these special sessions can be met. Details concerning adherence to and compliance with the schedule may be sought by communication with the respective Clerk's offices, as the need arises.
